Activision hat einiges getan, um Call of Duty zu promoten und zu unterstützen. Allerdings haben sie dabei auch gegen geltendes Recht verstoßen.
Activision wird verklagt. Diese Schlagzeile ist mittlerweile keine allzu seltene mehr, wenn man einen kurzen Blick auf die Vergangenheit wirft. Diesmal ist es jedoch das Unternehmen Plaintiff AM General LLC, welches die rechtlichen Schritte einleitet. Dem Hersteller von Humvee-Fahrzeugen ist aufgefallen, dass Activision gerade diese immer wieder in seinen Spielen aus der Call of Duty Reihe verwendet. Allerdings ohne zuvor die Firma gefragt zu haben, ob das denn überhaupt in Ordnung sei. Die Marke erscheint zusätzlich auch noch auf einigen Merchandise-Artikeln von Call of Duty, wie Büchern und Spielzeugen, wodurch sich Activision zusätzlich weiteres Geld durch eine fremde Marke dazuverdienen konnte.
Das rächt sich nun. AM General hat offiziell Klage eingereicht und zieht den Entwickler und Publisher damit zur Rechenschaft. Die Klageschrift, die am 7. November von der Firma eingereicht wurde, beinhaltet für die Entschädigung der Markenrechtsverletzung eine Unterlassungserklärung, Schadensersatz und Bußgeld. Dabei soll die Auseinandersetzung der beiden Unternehmen bereits vor einem Jahr stattgefunden haben. Da es jedoch zu keiner außergerichtlichen Einigung gekommen war, hatte sich AM General schließlich für den rechtlichen Schritt entschieden.
Aktuell hat sich Activision noch nicht öffentlich zu dem Thema geäußert. Wie der Rechtsstreit daher weitergehen wird, wird sich in der Zukunft zeigen.
